Appeals Court Strikes Down Reciprocal Tariffs; Appeal Pending

Last week, the Court of Appeals for the Federal Circuit struck down President Trump’s use of emergency powers (IEEPA) to impose tariffs, including the reciprocal tariffs on much of the world and the fentanyl/border crossing tariffs on China, Mexico and Canada. Importantly, this does not impact tariffs issued under other legal authorities, e.g., Sec. 232 tariffs on steel and aluminum imports.

The IEEPA tariffs will remain in effect until Oct. 14, giving the Trump administration time to appeal the decision to the Supreme Court. If the ruling is upheld, IEEPA tariffs paid may have to be refunded by the federal government. Click the link below to read more.

ASMFC Seeks Public Input on Red Drum Management

Beginning Sept. 15, the Atlantic States Marine Fisheries Commission will host public meetings on Red Drum Draft Addendum II, which will consider changes to the management programs for the southern (South Carolina through the east coast of Florida) and northern (New Jersey through North Carolina) regions of red drum. The Draft Addendum considers changes to the recreational bag and slot limits of states in the northern region, as well as provides states the opportunity to align their differing regulations, particularly in Chesapeake Bay.

ASA Thanks President Trump for Action to End De-Minimis Entry

Last week, ASA sent a letter to President Trump expressing our gratitude for his leadership and swift action to suspend de minimis exemption for all countries, putting U.S. manufacturers on equal footing. Ending the de minimis entry closes the loophole that allows foreign retailers and e-commerce marketplaces to avoid duties and excise taxes that fund conservation. This bold step is a critical victory for American sportfishing businesses.

Dept. of the Interior Expands Hunting and Fishing Access at National Wildlife Refuges

Last week, the Department of the Interior (DOI) announced 42 new hunting and sport fishing opportunities across more than 87,000 acres within 16 units within the National Wildlife Refuge System and one unit in the National Fish Hatchery System. These units are in Alabama, California, Idaho, Maine, Maryland, Massachusetts, Michigan, Montana, North Carolina, Texas and Washington.

ASA applauds the Department for taking this step to improve access and work closely with state partners to maintain consistency and align with state regulations. We look forward to working with the administration to identify further opportunities for recreational fishing on federal lands.

Sportfishing Industry Mourns the Passing of Flip Pallot

ASA and the entire recreational fishing community is saddened by the sudden and tragic passing of Flip Pallot. For almost four decades, Flip was instrumental in promoting recreational angling and a fierce advocate for fisheries conservation. His presence will be missed dearly and we extend our sincerest condolences to his family.
