Garmin: It’s Time to Set the Record Straight

The following is a letter from Garmin Vice President of Worldwide Sales Dan Bartel to retailers of the company’s marine electronics:

Dear Garmin distributors, retailers and customers,

Last December, the International Trade Commission (ITC) issued a final determination in the investigation brought by Navico Holdings AS against Garmin. The ITC reversed an earlier decision by an administrative law judge completely vindicating Garmin and instead concluded that first generation Garmin DownVü™ scanning sonar products were too similar to at least one patented aspect of Navico DownScan technology. Garmin disagrees with the ITC and plans to appeal the determination, but we have already taken steps to ensure that we can continue to provide ITC compliant Garmin DownVü scanning sonar products.

Facts About the Impact

  • The ITC ruling has no impact on Garmin products already purchased by Garmin customers and dealers, or any products purchased going forward.
  • The ruling only applies to Garmin, and does not apply to anyone else, including our end customers, dealers and distributors.
  • The ruling has no impact on any existing dealer inventory or any products already purchased by our customers.
  • Any products our dealers have purchased can still be lawfully sold.

Garmin has not shipped any products that are in violation of the ITC ruling. We are shipping products that have a new design and are not subject to this ruling.

Navico is telling our dealers and distributors that they cannot sell the products they purchased prior to December 1. This is not true.

Navico is threatening legal action against dealers and distributors who continue to sell Garmin sonar products. To our knowledge, this is an empty threat and no legal action has been taken against anyone. If Navico takes any action against our dealers, Garmin will intervene in these actions, defending our dealers at our expense and holding Navico accountable, as these claims from Navico have no merit.

Garmin has excellent new products that are now shipping. All feature the Garmin quality and Garmin support you have come to value and trust.
